1. Acceptance of Terms

Welcome to Blooming Finances, a brand operated by Profitrackr LLC (“Company,” “we,” “our,” or “us”).

These Terms of Service (“Terms”) govern your use of:

  • Blooming Finances websites
  • The Financial Control System (FCS)
  • The Profitrackr Google Sheets Add-on
  • Digital downloads
  • Software
  • Courses
  • Documentation
  • Any related services provided by Profitrackr LLC

By purchasing, downloading, installing, or using our products, you agree to these Terms.

If you do not agree, do not use our products or services.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement.

3. License

When you purchase the Financial Control System, Profitrackr LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the software for your own personal or internal business use.

You do not own the software.

All intellectual property remains the exclusive property of Profitrackr LLC.

4. License Activation

Some products require activation through a license key.

Your license may be limited by:

  • Number of activations
  • Subscription status (if applicable)

  • Product purchased

We reserve the right to suspend or revoke licenses obtained fraudulently or used in violation of these Terms.

5. Acceptable Use

You agree not to:

  • Share license keys publicly
  • Reverse engineer, decompile, or attempt to extract proprietary source code except where permitted by applicable law
  • Circumvent licensing or security mechanisms
  • Use the software for unlawful purposes
  • Attempt to interfere with the operation of our services

6. Google Workspace Add-on

The Profitrackr Google Sheets Add-on requires a Google account and authorization to access the active spreadsheet in which it is installed.

Google’s own terms and privacy policies also apply to your use of Google Workspace products.

We are not responsible for Google’s services or any interruptions caused by Google.

7. Financial Disclaimer

Blooming Finances provides educational software and organizational tools.

We are not:

  • Financial advisors
  • Investment advisors
  • Tax advisors
  • Attorneys
  • Accountants providing professional services

Nothing in our software or website constitutes financial, investment, legal, or tax advice.

You remain solely responsible for your financial decisions.

8. Accuracy of Information

The software relies on information entered or imported by the user.

While we strive to provide accurate calculations, reports, and budgeting tools, we do not guarantee:

9. Payments

If a refund is granted, we may revoke the associated software license and deactivate access to licensed products.

Software updates may require internet connectivity or renewed authorization.

12. Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability.

We are not liable for outages caused by:

  • Google services
  • Internet providers
  • Hosting providers
  • Third-party integrations
  • Maintenance
  • Force majeure events

13. Intellectual Property

All software, spreadsheets, templates, source code, documentation, graphics, logos, branding, text, and content remain the intellectual property of Profitrackr LLC unless otherwise stated.

Nothing in these Terms transfers ownership of our intellectual property.

14. Limitation of Liability

To the fullest extent permitted by law, Profitrackr LLC shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the use of our products or services.

Our total liability for any claim shall not exceed the amount you paid for the applicable product during the twelve (12) months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless Profitrackr LLC, its owners, employees, contractors, and affiliates from claims, damages, liabilities, losses, and expenses arising from your use of the software or your violation of these Terms.

16. Termination

We reserve the right to suspend or terminate access to our software if you:

  • Violate these Terms
  • Misuse the software
  • Circumvent licensing
  • Engage in fraudulent activity

Termination does not relieve you of payment obligations incurred before termination.

17. Privacy

Your use of our products is also governed by our Privacy Policy.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States, without regard to its conflict of law principles.

Any legal action arising under these Terms shall be brought in the appropriate state or federal courts located in Maryland.

Updated versions will be posted on our website with a revised “Last Updated” date.

Continued use of the software after changes become effective constitutes acceptance of the revised Terms.

Any educational content, articles, examples, calculators, rankings, comparisons, or research—including information regarding investment products, mutual funds, exchange-traded funds (ETFs), stocks, bonds, savings vehicles, or other financial products—is provided solely for general informational and educational purposes.

References to specific investments, historical performance, expense ratios, market research, or other financial information should not be interpreted as recommendations or endorsements to buy, sell, or hold any particular investment or financial product.

You are solely responsible for evaluating whether any financial decision, investment, savings strategy, debt repayment strategy, or other financial action is appropriate for your individual circumstances.
